Welcome to Visible Vantage. These Terms of Service (“Terms”) govern your use of the website at visiblevantage.com (“Site”) and all services offered by Visible Vantage, including web hosting, domain registration, and professional email services (collectively, the “Services”).

1. Acceptance of Terms

By accessing, browsing, or using the Site or Services, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must immediately cease all use of the Site and Services. Visible Vantage reserves the right to update or modify these Terms at any time without prior notice, and your continued use of the Services signifies your acceptance of the revised Terms.

2. Definitions

“Visible Vantage,” “We,” “Us,” “Our: Refers to the company operating visiblevantage.com.
“User,” “You,” “Your: Refers to the individual or entity who uses the Services or accesses the Site.
“Services: Includes, but is not limited to, web hosting, domain name registration, email hosting, dedicated servers, VPS, and associated technical support.
“User Content: Any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links, and other content or materials that you submit, post, display, or otherwise provide on or through the Services.

3. Account Registration and Access

3.1. Eligibility

You must be at least 18 years old to use the Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years old and legally capable of entering into a binding contract.

3.2. Account Security

You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify Visible Vantage immediately of any unauthorized use of your account or any other breach of security.

3.3. Accurate Information

You agree to provide true, accurate, current, and complete information during the registration process and to maintain and promptly update this information as necessary to keep it accurate and complete.

4. Service Provision and Acceptable Use

4.1. Service Levels

Visible Vantage will use commercially reasonable efforts to provide the Services 24 hours a day, 7 days a week, subject to maintenance windows, unexpected outages, or force majeure events. We guarantee a 99.9% uptime for core hosting services as specified in our separate Service Level Agreement (SLA).

4.2. Prohibited Uses

You agree not to use the Services for any illegal or unauthorized purpose. Prohibited uses include, but are not limited to:

Illegal Content: Hosting, distributing, or linking to content that is illegal, defamatory, hateful, or obscene.
Copyright Infringement: Hosting any material that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party (DMCA policy applies).
Network Abuse: Engaging in any activity that interferes with or disrupts the Services or the servers and networks connected to the Services, including sending unsolicited bulk email (spamming).
Security Violations: Attempting to probe, scan, or test the vulnerability of the Services or any network, or breach security measures without proper authorization.
Resource Abuse: Operating any software or process that consumes excessive system resources (CPU, RAM, Disk I/O) that negatively impacts the performance of other users on shared hosting environments.

4.3. User Content

You are solely responsible for all User Content uploaded, stored, displayed, or transmitted via your account. Visible Vantage does not claim ownership of User Content, but you grant us a worldwide, royalty-free license to use, reproduce, modify, and distribute User Content solely for the purpose of providing the Services to you.

5. Payment, Billing, and Refunds

5.1. Fees

You agree to pay Visible Vantage all fees for the Services according to the prices and terms presented in the order process. All payments are non-refundable unless otherwise stated.

5.2. Automatic Renewal

Unless you notify us of your intent to cancel, your Services will automatically renew at the end of the current term, and you authorize us to charge your current payment method for the renewal fees.

5.3. 30-Day Money-Back Guarantee

We offer a 30-day money-back guarantee for all new Shared Hosting plans. This guarantee does not apply to domain registration fees, setup fees, dedicated servers, or any third-party licenses.

5.4. Late Payment

If an invoice remains unpaid for [e.g., ten (10)] days, Visible Vantage may suspend or terminate the Services without further notice.

6. Termination

6.1. Termination by User

You may terminate your account at any time by contacting our billing department via the customer portal. You will be responsible for all fees incurred up to the effective termination date.

6.2. Termination by Visible Vantage

Visible Vantage may terminate or suspend your account and access to the Services immediately, without prior notice or liability, if you breach any provision of these Terms, particularly Section 4.2 (Prohibited Uses). Upon termination, your right to use the Services will immediately cease.

7. Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Visible Vantage expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the Services will meet your requirements, or that the Services will be uninterrupted, timely, secure, or error-free.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Visible Vantage shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Visible Vantage has been advised of the possibility of such damages), resulting from the use or the inability to use the Services.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your State/Country of Incorporation], without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in [Your City/County of Incorporation] to resolve any dispute arising out of your use of the Services or these Terms.
